GENERAL PROVISIONS
These General Terms and Conditions of Sale (hereinafter, “General Conditions”) apply exclusively between ALPEN SAS DI ATENA SRL (REA _____ and VAT no. 01438690214), with registered office at Via Alessandro Volta, 3 (hereinafter “ALPEN”) and any Customer, and govern the purchase of products and services made via the internet on the website www.alpen.shop. The terms and conditions are an integral part of the purchase contract concluded between the seller and the customer. ALPEN invites each Customer, before making any purchase, to carefully read the General Conditions and, once the purchase procedure is completed, to keep a copy, either in paper or electronic format as provided for by art. 51 paragraph 1 of Legislative Decree 206/205 as amended by Legislative Decree 21/2014.

OBJECT OF THE CONTRACT – OFFER TO THE PUBLIC
In compliance with and in accordance with these General Conditions, ALPEN sells and the Customer purchases remotely the products indicated and offered for sale on the website www.alpen.shop. The contract is concluded exclusively through the internet network, by accessing the Customer to the address www.alpen.shop and creating a purchase order according to the procedure provided by the site itself. The Customer, before proceeding to confirm their order, undertakes to read these General Conditions and to accept them by clicking on the ‘Confirm Order’ button, thereby declaring that they have read and accepted these General Conditions.
The products and services with their respective prices on the Site constitute a public offer in accordance with the methods specified in the General Conditions and on www.alpen.shop. The conditions of this offer apply exclusively to purchases made on the aforementioned website.

PRE-CONTRACTUAL INFORMATION FOR THE CONSUMER under art. 49 of Legislative Decree no. 206/2005
The Customer, before concluding the purchase contract, undertakes to read carefully the characteristics of the products illustrated in the individual product sheets.
Before validating the order with “obligation to pay”, the Customer will be informed with reference to:
– the total price of the goods including taxes, with a breakdown of the shipping costs and any other cost;
– payment methods;
– the term within which ALPEN undertakes to deliver the goods;
– conditions, terms, and procedures for exercising the right of withdrawal (art. 7 of these Conditions) through the standard withdrawal form referred to in Annex I, Part B of Legislative Decree 21/2014;
– information on the cost of returning the goods in case of withdrawal at the expense of the Customer and the Consumer;
– the existence of the legal guarantee of conformity for the purchased products and the commercial guarantees provided.

Order and conclusion of a contract
The buyer chooses a product based on the current offer published in the online store, confirms the selection by clicking on the “Buy” button, fills out the order form (indicating the email address and the delivery address in case of product purchase), chooses the quantity of products (or specifies other product parameters), and selects the payment method. Orders placed through the online store are binding. When placing an order, the buyer confirms that they are informed and accept these Terms and Conditions by clicking on the designated button.
The placement of goods offered in the online store constitutes the proposal to conclude a contract, which is then concluded through the buyer’s order confirmation and the seller’s acceptance of the said order. After processing the order, the seller will promptly send the order receipt confirmation (order acceptance) to the email address provided by the buyer. This confirmation includes the order number, name, and specification of the goods, price information, and delivery charges (postage), payment method, expected delivery date of the goods, delivery location, seller information, and other details. The purchase contract is concluded upon receiving an email confirmation that we have received the customer’s order.
If the buyer has created an account with our online store, the order will also be stored in the “My Orders” section, which will be accessible only after logging in. If necessary, any additional information regarding the order can be sent to the buyer’s email address.
The contracting parties agree that communication between them will take place via email.
The buyer must pay the agreed price in the order confirmation, including delivery charges (hereinafter “purchase price”) through the payment method chosen during the order.
Information about the specific steps leading to the conclusion of the contract is derived from these Terms and Conditions. The buyer always has the opportunity to verify and, if necessary, correct the contract before confirming the order.
Additionally, the operator will provide the buyer with the required documents related to the goods: invoice (tax document), and possibly the warranty certificate (if provided by the manufacturer).

Product availability
The availability of products on the site is merely indicative, as it is not updated in real-time due to the simultaneous presence of multiple users on the site or any IT anomaly that makes a product available for purchase when it is not.
Cases of partial or total unavailability of goods may also occur after the order confirmation email has been sent. In this event, ALPEN will inform the Customer by email within 48 working hours, and the Customer can decide within the next 48 hours whether to place a new order by removing the unavailable product(s). If there is no response to the aforementioned email, the order will be considered canceled, and the Customer will receive all information on the refund procedures and timelines for any amounts already paid.

Price
All prices of goods and services are final, including VAT; however, the price does not include delivery costs. Product prices do not include additional taxes, duties, or charges required by applicable legislation, such as those provided for in import matters, which will be borne by the Customer if applicable.
All special offers are valid while stocks last, unless otherwise specified for a particular product.
Additional discounts applied in addition to discounts on products on our website, discounts for individual customers, or discounts applied based on our online store’s collaboration with third parties are not cumulative.
The final price is indicated in the order form just before the order confirmation and includes VAT and any other taxes and charges (packaging, postage) that the customer must pay to receive the goods or service. The seller cannot unilaterally modify the price.

Payment method, postage, and other charges
The buyer must pay the purchase price to the seller through:

Delivery conditions
Goods available in stock are shipped the next working day.
Goods not available in stock are always marked as “Currently unavailable.”
Unless otherwise agreed upon by the seller and the buyer in the purchase contract, we, as the seller, must process the order and deliver the goods no later than thirty (30) days from receiving the order. If the ordered goods, or part of them, cannot be delivered within the specified period, we will inform the customer as soon as possible and advise on the expected delivery date of the goods or suggest delivering substitute goods. If we cannot provide the goods within the additional period, the customer has the right to withdraw from the contract. If the customer has already paid the total or partial purchase price, they will receive a refund within fourteen (14) days by bank transfer to their preferred bank account.
Orders are processed on working days.

Order cancellation – right of withdrawal
Right of Withdrawal: The Consumer Customer has the right to withdraw from the Purchase Contract for any reason and without needing to provide explanations within 14 days from the date of receipt of the products, subject to compliance with the procedures indicated below.
If the Consumer Customer intends to exercise the right of free withdrawal, they must fill out the form available at the following link. If the Customer intends to exercise the return following the delivery of defective or non-conforming products, they can use the return form. In both cases, ALPEN will communicate to the Customer via email the confirmation of the order cancellation or withdrawal, with an indication of the return procedure number and the address to which the returned product should be sent.
The return must be made by the Customer, through the shipment of the products subject to withdrawal, by courier of their choice. The products must be shipped, with all necessary packaging precautions, within 14 days from the date on which the Customer communicated their decision to withdraw from the contract to the indicated address. The direct costs of returning the goods will be borne by the Customer.
The Customer will be responsible for the decrease in the value of the Products resulting from handling the goods other than what is necessary to establish their nature, characteristics, and functioning. For the valid exercise of the aforementioned right of withdrawal, the Consumer Customer must comply with the following conditions and methods:

the withdrawal may also apply to individual products forming part of a single Purchase Contract, provided that the withdrawal applies to the product in its entirety, i.e., the Consumer Customer cannot exercise the withdrawal limited to part of a single purchased product;
the products forming part of Purchase Contracts for which the Consumer Customer has exercised the right of withdrawal must be intact and returned in their original packaging, complete in all its parts (including packaging and any ancillary documentation); in particular, if the products have packaging seals, these must not be broken or removed;
following the instructions received from ALPEN, the Consumer Customer will arrange, at their exclusive expense and care in the case of free withdrawal and at the expense and care of ALPEN in the case of withdrawal for defective or non-conforming products, the shipment and return of the products to ALPEN.
if the returned product is damaged during transport, ALPEN will inform the Consumer Customer of the incident to allow them to file a timely complaint with the chosen courier, against whom they can seek redress. ALPEN will not be liable in any way for theft or loss of products subject to return, with any related risk remaining exclusively with the Consumer Customer.
Once the integrity of the returned product has been verified, ALPEN will refund the Consumer Customer the entire amount paid for the products subject to the Purchase Contract, including any delivery costs, within 14 days from the return of the same products.
In case of damage to the returned products, the Consumer Customer will be liable only for the decrease in the value of the goods resulting from handling the goods other than what is necessary to establish their nature, characteristics, and functioning, as provided for by article 57, paragraph 2, of the Consumer Code.
The Consumer Customer expressly consents to the refunds mentioned above being made by credit card reversal indicated by the customer or via PayPal, or by bank transfer, in accordance with the instructions and bank details that will be provided by the Consumer Customer themselves.
In any case of non-compliance with the conditions and methods of exercising the withdrawal provided for in this article, as well as in case of damage to the products for reasons other than transportation, even if different from the cases provided for by article 57, paragraph 2 of the Consumer Code, the Purchase Contract will remain valid and effective, and ALPEN will return the improperly returned products to the Consumer Customer, charging them the related shipping costs.
Legal guarantees
Legal Guarantee for the Consumer Customer: The Consumer Customer, as defined in art. 3 of the Consumer Code (Legislative Decree no. 206/05), is entitled to take advantage of the legal guarantee provided by the Consumer Code itself in articles 128 to 132.
ALPEN is responsible towards the Consumer Customer for any conformity defects of the products existing at the time of delivery, particularly for products that are defective or damaged, for two (2) years after the delivery of the products.
The Consumer Customer loses the rights recognized if they do not report the conformity defect found to ALPEN within two (2) months from the date they discovered the defect.
ALPEN will make every diligent effort to replace, at its expense, with other products of the same quality available in its warehouses, the products delivered that prove to be damaged or defective, provided that, at ALPEN’s request, the same are returned by the Customer in their original packaging, complete with all parts. If replacement is not possible (e.g., product out of catalog), ALPEN will refund the Customer the amount paid for the defective product, excluding any further liability, for any reason, of ALPEN.

Delivery methods
All product deliveries will be at ALPEN’s risk. The risk will be transferred to the Customer at the time of delivery of the products to the Customer, or to a third party designated by them, by the shipper or carrier appointed by ALPEN. The designated courier by ALPEN is BRT S.p.A. Shipping costs will be automatically calculated by the Site and will be viewable and knowable by the Customer before sending the order. The same vary from country to country and for Italy may vary based on the chosen payment method.
For each Purchase Contract perfected through the Site, ALPEN will issue a delivery note (Ddt).
Deliveries will be made as follows:
– 1st attempt
– 2nd attempt
Force majeure, unavailability of transport means, as well as unpredictable or inevitable events causing a delay in deliveries or making deliveries difficult or impossible or causing a significant increase in delivery costs borne by ALPEN, will entitle the latter to fractionate, postpone or cancel, in whole or in part, the expected delivery or terminate the Purchase Contract. In such cases, ALPEN will provide timely and adequate communication of its decisions to the email address provided by the Customer, and the latter will have the right to a refund of the price eventually already paid, excluding any further claim, for any reason, against ALPEN.

Responsibility
ALPEN assumes no responsibility for disruptions due to force majeure or fortuitous events, even if dependent on malfunctions or disruptions of the internet network, in the event that it fails to execute the order within the times stipulated in the contract.

Applicable law and competent court – extrajudicial dispute resolution
These General Conditions are governed by the Civil Code, the Consumer Code (Legislative Decree no. 206/2005 and subsequent amendments) and the rules on electronic commerce (Legislative Decree no. 70/2003 and subsequent amendments). In case of changes to the same, the General Conditions published on the Site at the time of sending the Order by the Customer will apply.
The Purchase Contract between the Customer and ALPEN is concluded in Italy and is governed by Italian law.
For any dispute, the Judicial Authority of Bolzano will have exclusive jurisdiction, except for disputes with Consumer Customers, which will be under the jurisdiction of the Judicial Authority of the place of residence or domicile of the Consumer Customer.
The Consumer Customer has the right to promote the extrajudicial resolution of disputes concerning the consumer relationship at the Chambers of Commerce, Industry, and Crafts institutes pursuant to Law 29/12/1993 no. 580 as well as to resort to mediation procedures referred to in Legislative Decree 28/2010 and subsequent amendments, under the conditions provided by the body chosen by the Customer that will administer such procedure.

We recommend shipping with couriers that offer the possibility to track the goods; shipping costs are at the sender’s expense.

Products without original labels/worn or washed products will not be replaced.
